II Use of cookies and other tracking technologies
1. What are cookies?
Like all other commercial websites, the website also uses so-called cookies and other tracking technologies (hereinafter collectively referred to as "cookies").
Cookies are small text files that are stored locally in the main memory or on the hard disk of your computer or mobile device (hereinafter referred to as "end device") and that can perform very different functions and process data for various purposes. If the corresponding website is called up again, the user's browser sends back the content of the cookies and thus enables the user to be recognized. Third-party technologies such as scripts, pixels and tags that Engel & Völkers integrates for advertising purposes also set cookies on your end device. Certain cookies are automatically deleted at the end of the browser session (so-called session cookies), others are stored in the user's browser for a specified period of time or permanently and then delete themselves automatically (so-called temporary or permanent cookies). Many cookies contain a so-called cookie ID. A cookie ID is a unique identifier of the cookie that allows websites and servers to be assigned to the specific internet browser in which the cookie was stored. This enables the websites visited to distinguish the user's browser from other Internet browsers; cookies cannot identify you as a person. However, the cookie makes it possible to identify your end device.
a. Types of cookies
There are different types of cookies that we use:
(i) So-called technically necessary cookies
Firstly, we use technically necessary cookies to operate the website. Technically necessary cookies are essential for the functionality of the website, without them the website would not be usable or only usable to a limited extent. The user data collected by technically necessary cookies is not used to create user profiles. This also includes temporary cookies (session cookies). They do not collect any data from your computer and are automatically deleted as soon as you close your browser.
Technically necessary cookies are also used for the use of our Consent Management Platform of the service provider Didomi SAS (hereinafter the "CMP Tool") to obtain your consent to the setting of cookies and the use of other tracking technologies.
Technically necessary cookies are "strictly necessary" cookies within the meaning of the ePrivacy Directive 2002/58 EC and do not require consent. For the area of application of the Federal Republic of Germany, the legal basis for their use is § 25 II TDDDG. If personal data is processed in this context, the legal basis is Art. 6 para. 1 sentence 1 lit. f GDPR (legitimate interest).
(ii) So-called. Cookies that are not technically necessary
There are also cookies that are not technically necessary. Such cookies serve very different purposes, such as optimizing the website, creating user profiles and displaying interest-based advertising. In principle, it can be said that these are for analysis or marketing purposes.
Insofar as we use such cookies for analysis or marketing purposes, we process your data on the basis of your consent in accordance with Art. 6 para. 1 sentence 1 lit. a) GDPR. You give us this consent using the CMP tool. Alternatively, Art. 6 para. 1 sentence 1 lit. f) GDPR (legitimate interest) may also be the legal basis for such cookies for analysis or marketing purposes. Please refer to our CMP tool for further information (accessible via the menu item "Manage cookie settings" at the bottom of the website). Here we have listed in detail the purposes for which we use cookies for analysis or marketing purposes and on what legal basis. You will also find further explanations below.
b. The management of cookies in our CMP tool
You can inform yourself and decide for yourself which cookies are used when you use the website, which service provider / partner (so-called "vendors") may offer them, which of your data is processed in the process and whether you wish to consent to this.
To enable you to make this informed decision, we use a cookie consent management process (the CMP tool described above), in the context of which your consent to the use of cookies or the processing and vendors mentioned in the cookie consent management process is obtained, managed by you and - if desired - can also be revoked. The declaration of consent is stored so that it does not have to be requested again and your consent can be proven in accordance with legal obligations. The storage can take place on the server side and/or in a cookie (so-called "opt-in cookie" or with the help of comparable technologies) in order to be able to assign the consent to a user or their end device. Subject to individual information on the providers of cookie management services, the following information applies: Consent may be stored for up to 12 months. A pseudonymous user identifier is created and information on the scope of consent (e.g. which categories of cookies and/or service providers) is provided at the time consent is given.
The CMP tool helps you to filter various cookies, trackers and analysis tools used by us and, if applicable, our vendors according to the user for an overview, to select them according to their processing purpose and - if desired - to deactivate them generally or individually. However, you cannot deactivate technically necessary cookies, trackers and analysis tools for the reasons described above.
To access this CMP tool (again if necessary), please click on "Manage cookie settings" (accessible via the menu item at the bottom of the website).
As explained above, you can therefore use the website free of non-technically necessary cookies and other tracking mechanisms, both initially and subsequently. In this case, only the technically necessary cookies, trackers and analysis tools that are required for the use of the website remain in place.
Note on consent: Some of the services listed in the CMP tool are set by our vendors or we transmit your data to these vendors. You can find more information in our CMP tool.
Note on consent: Some of the services listed in the CMP tool transfer data to the USA. Data processing and the protection of your data in the USA do not comply with the GDPR standard. The services / vendors are subject to US law and may therefore be obliged to disclose data to US authorities or US intelligence agencies if legal requirements are met. Risks for you exist in particular due to the more difficult enforcement of the law, the lack of control over the further processing or disclosure of your data and the aforementioned access by government agencies. You can also find more information in our CMP tool.
To exercise your cookie settings/objection option in this regard, please click on "Manage cookie settings" (accessible via the menu item at the bottom of the website).
c. Managing cookies via your browser
You can also deactivate the storage of cookies via your browser settings and delete cookies already stored in your browser at any time. Please note, however, that the website or the online offer may not function or only function to a limited extent without cookies. We also recommend that you visit the website of www.YourOnlineChoices.com website, which provides you with information and assistance in connection with web tracking mechanisms. A central opt-out option for various tools, particularly from US providers, is also available at the following link: optout.networkadvertising.org.
2. Summary of the purposes for which we set cookies or process personal data in the context of web tracking
a. To create individual offers of our services or the services of our license partners
If you have consented in accordance with Art. 6 para. 1 a GDPR, we set cookies and / or process personal data such as your IP address or work with unique identifiers (a unique identifier, UID for short, is a unique identifier consisting of codes in the form of character strings of numbers and letters) to inform you about our services. In doing so, we also take into account your preferences resulting from your usage behavior on our website.
You can find these cookies in our CMP tool under the following headings:
Select personalized ads
Select personalized content
Storage of and access to location data for targeted advertising
b. Usage profiles based on statistical evaluations for the needs-based design of the website
We need statistical information about the use of the online offer on the website in order to make it or its content more user-friendly and to conduct market research or a reach analysis. We use web analysis tools ("tools") for this purpose. Usage profiles are created with the help of analysis cookies or by evaluating your log files. The providers of these tools generally process your data as processors in accordance with our instructions and not for their own purposes. The tools either do not use users' IP addresses at all or shorten them immediately after collection.
The legal basis may be your consent (if we process your personal data, the legal basis is Art. 6 para. 1 a) GDPR; if we use cookies and do not process personal data, the legal basis is the ePrivacy Directive 2002/58 EC or, in the area of application of the Federal Republic of Germany, § 25 II TDDDG). In addition, Engel & Völkers may also have an overriding legitimate interest in a needs-based, user-oriented design and statistical evaluation of the website. The legal basis for data processing is then Art. 6 para. 1 f) GDPR.
For the aforementioned purposes, we use cookies for the website and its subpages, both our own cookies and those of third-party providers, which we transmit to your computer via your web browser. They enable our systems to distinguish your browser from others. On the one hand, we send you so-called persistent cookies. On the other hand, we use so-called session cookies, with the help of which you receive a session ID for the duration of a visit to our pages, which enables us to distinguish you from other visitors to the website.
You can find these cookies in our CMP tool under the following headings:
Store and/or retrieve information on a device
Measure content performance
Develop and improve products
Use market research to gain insights about target audiences
Measure ad performance
Select simple ads
Use accurate location data
Actively query device properties for identification
You will also find the partners we work with in our CMP tool, sorted alphabetically.
Some of the services listed in the CMP tool transmit data to the USA. Data processing and data protection in the USA do not meet the standard of the GDPR. The services are subject to US law and may therefore be obliged to disclose data to US authorities or US intelligence agencies if legal requirements are met. Risks for you arise in particular from the difficulty of enforcing the law, the lack of control over the further processing or disclosure of data and the aforementioned access by government agencies. Some providers, such as Google, may also process data for their own purposes. In these cases, data processing takes place on the basis of your consent, see Art. 6 I lit. a GDPR.
You can also find more detailed information in our CMP tool (accessible via the menu item "Manage cookie settings" at the bottom of the website).
3. Links to social media pages
Our website sometimes contains links to the most important social media network sites (e.g. Facebook and Twitter). In this respect, this is not the embedding of social media plug-ins, but a link where personal data is not transmitted to the social media operators.
III. transfer of your personal data and transfer to non-EEA countries where applicable
Please refer to the information within our CMP tool to find out to what extent we share personal data with our partners and whether these partners are based in third countries.
The recipients of personal data may be located outside the EEA/UK. If personal data is transferred to locations outside the EEA/UK, we will ensure, as required by law, that your data protection rights are adequately protected, either because the European Commission has decided that the country to which personal data is transferred ensures an adequate level of protection (Art. 45 GDPR) or the transfer is subject to appropriate safeguards (e.g. standard contractual clauses) of the European Union agreed with the recipient (Art. 46 GDPR), unless the GDPR provides for an exception (Art. 49 GDPR). Furthermore, where necessary, we intend to agree additional measures with the recipients to ensure an adequate level of data protection. Copies of the appropriate safeguards (to the extent we rely on them) and a list of recipients outside the EEA/UK may be requested. Please note that these copies may be redacted to the extent necessary to protect trade secrets or other confidential information.
IV Storage and deletion of data
Engel & Völkers stores your personal data for the time necessary to achieve the purposes for which data is collected and further processed, including any retention period required by applicable law (e.g. retention of accounting records). Please refer to our CMP tool for further information on the retention period.
V. Data protection information
You can find information on responsibilities, our contact details and your rights in the context of data processing in our data protection information.
